1. ELIGIBILITY:
This contest is open to residents of Canada, excluding residents of Quebec, over the age of majority in their province of residence, except employees of The Second Cup Ltd., “Second Cup” and their respective partners and affiliates and their respective advertising and promotional agencies, the independent judging organization, and all persons with whom they are domiciled.
2. HOW TO ENTER:
No Purchase Necessary. You may only enter once. There will be two methods of contest entry. All contest entries must be received on or before 11:59 p.m. EST Friday, August 29, 2008 (“Contest Closing Date”). To be entered into the contest:
a) Visit the Second Cup website at www.secondcup.com, complete the online entry form, including your name, complete address and daytime telephone number (with area code) and click the submit button and you will be entered in the contest.; or
b) Mail an envelope bearing sufficient postage and containing one piece of paper, on which is printed legibly by hand, your name, complete address and daytime telephone number (with area code), to www.secondcup.com Contest, Request for Contest Entry, 6303 Airport Road. Mississauga, Ontario. L4V 1R8. You may only enter once. No mechanical reproductions will be accepted.
3. PRIZES:
There will be a total of 10 prizes available to be won. Each prize consists of a $100 Second Cup Gift Card. Prizes must be accepted as awarded, are not transferable except at the sole discretion of Second Cup and are not convertible to cash. Second Cup reserves the right to substitute a prize of equal or greater value in the event that the specified prize is unavailable due to circumstances beyond Second Cup’s control. Only one (1) prize may be awarded per person.
4. DRAW:
Random draws will be conducted by an independent judging organization at or shortly after 12:00 p.m. EST at Second Cup at 6303 Airport Road, Mississauga, Ontario on Friday, September 12, 2008 from among all eligible entries received on or before the Contest Closing Date. Odds of being selected are dependent on the total number of eligible entries received by the Contest Closing Date.
5. SKILL TESTING QUESTION REQUIREMENTS:
In order to be declared a winner, selected entrants must correctly answer unaided by any mechanical or electronic calculations device or otherwise, a time-limited, mathematical skill-testing question at a predetermined mutually convenient time administered by e-mail or telephone.
6. CONDITIONS OF PARTICIPATION:
By participating in this contest participants agree:
a) All entries become the property of Second Cup and none will be returned. No correspondence will be entered into except with the selected entrants who will be notified by mail or telephone not later than Friday, September 26, 2008 and informed of all necessary arrangements. In the event that a selected entrant cannot be contacted within fourteen (14) days of the contest draw another entrant will be selected by the independent judging organization. Contest winners must consent to the use of their names, photograph, voice, video footage and/or statements for publicity purposes without compensation, in any future publicity carried out by Second Cup in connection with this or any similar contest.
b) All decisions of the independent judging organization are final.
c) The prize may be forfeited and an alternate winner may be selected unless a winner signs and returns, within ten (10) days of the date of the accompanying cover letter, a standard declaration and release form, confirming eligibility and compliance with the contest rules and releasing Second Cup and their respective partners and affiliates and their respective advertising and promotional agencies, and the independent judging organization from all liability caused by, resulting from, or arising out of the acceptance or use of the contest prize, the use of any personal information or the use of merchandise or services purchased in relation to winning a prize.
d) Second Cup and their respective partners and affiliates and their respective advertising and promotional agencies, and the independent judging organization each assume no responsibility for lost, stolen, delayed, damaged, or misdirected entries, or for any failure of the website during this contest, for any problems or technical malfunction of any telephone network or lines, computer online systems, services, access providers, computer equipment, software, failure of any e-mail or entry to be received by Second Cup on account of technical problems or traffic congestion on the internet or the website or any combination thereof including any injury or damage to an entrant’s, or any other person’s computer, related to or resulting from playing or downloading any material in the promotion. Any attempt to deliberately damage the website or to undermine the legitimate operation of this promotion is a violation of the Criminal and Civil laws, and should such an attempt be made Second Cup reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.
e) This contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
f) Any and all taxes assessed as a result of receiving a prize will be the responsibility of the respective winner(s). Any other costs are the responsibility of the winner(s).
g) Entrants agree that the personal information collected for purposes of this contest can be collected, used and disclosed by Second Cup in accordance with its privacy policy which is available on its web site.
h) The Second Cup Ltd. reserves the right, in its sole discretion, to change the terms of this contest or to cancel or suspend this contest at any time for any reason whatsoever, without prior (or any) notice.
